Common Legal Fee Structures:

Hourly Rates: Lawyers charge a fixed rate for each hour (or fraction thereof) spent on a case. Rates in India for freelance lawyers depending on expertise and location. Corporate lawyer hourly rates depending on experience and firm reputation.
Fixed Fees (Flat Fees): A predetermined total amount is charged for a specific legal service (e.g., drafting a contract, handling an uncontested divorce). These can depending on the case complexity and scope.
Contingency Fees: The lawyer’s fee is a percentage of the amount the client recovers in a case (common in personal injury cases). This is less common in India compared to some other countries and is prohibited in criminal and divorce cases. Percentages can range from 10% to 40% of the recovery.
Retainer Fees: An upfront payment made by the client to secure the lawyer’s services. The lawyer then bills against this retainer.
Hybrid Models: Combinations of the above, such as a reduced hourly rate plus a contingency fee.

Ethical Considerations:

Lawyers should not overcharge or undervalue their services.
A client’s ability to pay can influence the fee, with consideration for reduced fees or pro bono work for those with financial hardship.
Charging fees based on the success of the matter or as a percentage of the recovery (except for permissible contingency fees) is generally prohibited.
Referral fees to other lawyers are permissible only if the total fee is reasonable and the client agrees.
